Word of Mouth is Still the Best Way People Find Rented Property

    ESSEX, ENGLAND, August 10, 2013 /24-7PressRelease/ -- The tops three ways of finding a property to rent have been revealed by landlord insurance specialists Cover4LetProperty (http://www.cover4letproperty.co.uk), who carried out an independent survey* to find out about renters' habits.

The study highlighted how:

- nearly a fifth (18%) of people found rented accommodation via friends and family;
- 14% found a property using letting agents;
- 12% used a website to find their rented home;
- male renters were nearly four times more likely to choose a property based on a recommendation from friends and family, compared to female renters (23% vs 6%);
- overall, 18% of those questioned rented the second property they saw;
- 24% of male renters were most likely to view two, or more than four, properties before they found one they liked;
- over one in ten of their female counterparts (12%) picked the first home they viewed with the rest viewing two or three properties before they found one they wished to rent;
- 36% of respondents who rented the first property they saw are in the 30-39 age band.

Jurisdiction Issues in Global Intellectual Property

"An underlying premise in pure intellectual property issues is that the law should encourage and reward innovation," wrote Raymond T. Nimmer in his book, "The Law of Computer Technology: Rights, Licenses, Liabilities." In the modern digital world, traditional trade borders are collapsing and competitors can steal valuable intellectual property and send it around the world at the speed of light.

How can the general counsel of a Texas company obtain justice when the company is the target of theft, infringement, fraud or other unfair business practices? How can he navigate jurisdictional issues when protecting the company's intellectual property from foreign corporations? What are alternatives to financing multiple lawsuits throughout the world?

Determining where to fight the battle to protect these rights is a crucial decision. To date, there is no clear law on how the global community will handle international intellectual property jurisdictional issues. Here are some steps general counsel can take when thinking through these issues.

Unearth electronic evidence: Gathering evidence of theft, infringement and other unfair business practices often will include using computer forensics. Investigating electronic evidence can include looking at email messages, evidence of hacking, telephone communications, bank transactions, web sites, browser histories, press releases, file transfers, etc. Such electronic evidence, including the money trail, will help determine the identity of the potential defendants.Identify defendants: Using the gathered evidence to identify responsible parties can be difficult, so the legal department may need to dig deeply to figure out the corporate shell game. Separating various corporate subsidiaries and independent contractors that may be responsible for the theft and fraud will take time. Evidence trails can lead to employees, partners and officers, as well as other businesses.Review jurisdictional issues: Determining potential jurisdictions and venues for a lawsuit can be difficult when the offending party is not a Texas or even a U.S. business. Unfortunately, there is no true global intellectual property law. International intellectual property disputes often can involve simultaneous lawsuits in multiple countries throughout the world.

There are currently four main legislative proposals to establish rules on international jurisdiction, choice of law and enforcement of foreign judgments in intellectual property lawsuits. The American Law Institute (ALI) principles are based on the laws of the United States. But businesses considering global litigation should be aware that other principles exist, including the European Principles on Conflict of Laws in Intellectual Property (CLIP), the Japanese transparency principles and Korean Waseda principles, as well as private international law.

When the potential defendant is not a Texas or U.S. business, the legal department may need to establish specific jurisdiction by proving that the defendant purposely availed itself of the privilege of acting in the forum state, the cause of action arises from such acts, and exercise of jurisdiction is not unreasonable. Specific jurisdiction can stem from the stream of commerce, hacking trails, a website sliding-scale test (in which courts are more likely to find jurisdiction as the website's interactivity and the business' electronic contacts increase), licensing and franchise agreements, posted defamatory comments, commercial activities, agency and civil conspiracy with other defendants, patent and trademark infringement, securities fraud, etc.

Overall, in determining whether a court has specific jurisdiction over a defendant, the court will look to see if the defendant was doing business in the forum state. This case-by-case determination often hinges on the foreign business' use of intellectual property or wrongful actions in Texas or the United States.

Anchoring jurisdiction: Selecting a favorable court, jurisdiction and remedy can be essential in protecting a company's intellectual property. General counsel can improve the company's ability to select a favorable jurisdiction by including anchor-jurisdiction clauses in all contracts, including letters of intent, license agreements and employment contracts. Such language also should exist on all company websites and its other marketing materials. Registering the company's intellectual property in all places where it needs to be protected is key, as is identifying the most crucial markets in which to seek protection.Limiting costs and risk: It's worth exploring whether law firms will handle large infringement cases on a contingent or hybrid contract. That can prevent the company from paying large retainers to investigate and litigate expensive lawsuits that may last years.Governmental resources: When evaluating any significant commercial litigation case against a large international corporation registered to do business in the United States, general counsel should be aware of potential governmental resources. Corporations that commit fraud, violations of the Foreign Corrupt Practices Act or other significant illegal acts may have violated U.S. Securities and Exchange Act regulations, and they may be held accountable in whistle-blower recovery lawsuits. Exposing the illegal actions of the opposing corporation can result in a whistle-blower recovery, as well as a finding against the corporation that can be used in a civil action.

In the modern digital world, technology is breaking down many traditional borders. International trade and competition is more common than ever before. Many Texas and other U.S. businesses will find themselves in a highly competitive business environment where they are the target of intellectual property infringement and corporate espionage. It pays to prepare now.

Bearish Sentiment Continued amid Worries over Chinese Property Tax Plan

News headlines and economic data set the market in a negative tone and stocks and risky assets weakened further after the FOMC minutes indicated the possibility of an early termination of QE. In China, investors were cautious after the Chinese State Council report unveiled intention to extend the property tax pilot program and other measures to curb speculative demand and property prices. In the Eurozone, the disappointing PMI data suggested that the bloc’s economic outlook remained gloomy. Data in the US was also worrisome with headline Philly Fed index slumping and initial jobless claims climbing higher. Wall Street decline with the DJIA and the S&P 500 indices losing -0.34% and -0.63% respectively. In the commodity sector, the front-month contract for WTI crude oil slumped for a second consecutive day, falling to as low as 92.63 before settling at 92.84, down -2.50% while the Brent crude contract plunged to -1.79% during the day. The benchmark Comex gold contract rebounded after plummeting to 7-month low of 1554.4. The contract ended the day at largely flat at 1578.6.

At a State Council meeting, Chinese Premier Wen Jiabao announced that the government would accelerate measures to curb the country’s real estate market. Xinhua News, the CPC government’s press agency, stated that the government would take various measures “ranging from raising the minimum down payment and higher interest rates for second-home mortgages to putting a conditional ban on the buying of properties by non-local residents” as “21 of 27 cities monitored register sales of floor space more than five times the area of the corresponding holiday week last year and at higher prices”. Meanwhile, “40 of China's 70 major cities saw property prices rise from the previous year, compared with 18 cities in November and 14 in October”. The government would maintain (may increase) the land supply and boost the construction of the government-subsidized housing for low-income households. Xinhua also cited media reports that the government would raise down payment for second-home purchasers 70% from 60% and increase he mortgage rate 1.3 times the benchmark interest rate instead of the current 1.1 times.

In the Eurozone, manufacturing PMI slipped -0.1 point to 47.8 in February, compared with consensus of 48.4. Services PMI also surprisingly dropped -1.3 points to 47.3 during the month.US’ headline Philly Fed index plunged -6.7 points to -12.7. Intiaily jobless claims rose to 362K in the week ended February 16. This was largely inline with market expectations of 361K. However, this has sent the 4-week moving average +8K to 361K during the week while the continuing claims were up +11K to 3 148K in the week ended February 9.

The DOE/EIA reported that total crude oil and petroleum products stocks declined -1.25 mmb to 1094.70 mmb in the week ended February 15. Crude stockpile increased +4.14 mmb to 376.39 mmb as inventory soared in 3 out of 5 PADDs. Cushing stock added +0.42 mmb to 50.66 mmb. Utilization rate was down -0.9% to 82.9%.

Gasoline inventory dipped -2.88 mmb to 230.35 mmb as demand climbed +0.39% to 8.44M bpd. Production added +0.45% to 8.94M bpd while imports slid -17.35% to 0.51M bpd. Distillate inventory dropped -2.28 mmb to 123.63 mmb although demand fell -3.40% to 3.81M bpd. Imports gained +105.59% to 0.29M bpd while production fell -1.95% to 4.27M bpd during the week.

Doubts about Troika and China's Measures to Control Property Market Dominated Headlines

Headlines in 2 Germany newspapers unveiled doubts about the Troika among ECB policymakers. The immediate aftermath of the Italian election was the decline of the Sentix index. Meanwhile, the market focus was China’s property tax measures. This, together with the drop in non-manufacturing PMI in the world’s second largest economy, caused the CSI300 to plunge more than -4%. Wall Street climbed higher on late trading with the DJIA and the S&P 500 indices gaining +0.27% and +0.46% respectively.

Die Welt reported that some ECB members were worried about the central bank’s participation in the Eurozone rescue efforts as these might create a conflict of interest and compromise its independence. The newspaper cited that “the level of discomfort has reached such a level that there are considerations among some important members of the ECB to leave the troika entirely”. Yet, ECB board member Joerg Asmussen commented that the ECB would not leave the troika and stressed that the members “don’t see any threat to our independence while we are participating in the troika". Asmussen stated that “the ECB participation in the troika is key. We have great knowledge about Europe, its institutions, its economy and we especially provide expertise on macroeconomic and especially financial sector issues. We will not withdraw from the troika”.

In China, the non-manufacturing PMI slipped to 52.1 in February from 54 in January. Yet, the key issue leading to the selloff of Chinese stocks was concerns over government’s measures to control property price rises. These measures include an increase in income tax on homeowners who made profit from a property sale. If one buys a second home in cities where property prices increase rapidly, he/she has to pay higher interest and down payments home.

The RBA left the cash rate unchanged at 3% in March. Policymakers stated that further easing might be required as inflationary conditions remained benign. On the dataflow, the Eurozone retail sales probably added +0.3% m/m in January, following a -0.8% decline a month ago. The final data for services PMI might have stayed unchanged in 47.3 in February. In the US, the ISM non-manufacturing index might have slipped -0.2 point to 55 in February.
